Terms of Service

Welcome to Ma Styla. These Terms of Service (“Terms”) govern your use of the Ma Styla mobile application, website at mastyla.app, and all related services (collectively, the “Service”) operated by Ma Styla LLC (“Ma Styla,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use Ma Styla. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Your Account

• You must provide accurate information when creating your account.
• You are responsible for maintaining the security of your account credentials.
• You may not share your account or let others access it.
• You must notify us immediately if you suspect unauthorized access to your account.
• Usernames must be 3–30 alphanumeric characters. We reserve the right to reclaim usernames for any reason.

3. The Service

Ma Styla is an AI-powered fashion platform that allows you to:

• Upload images and generate AI-powered virtual try-on and pose-transfer images
• Publish and share generated images with other users
• Follow other users, like images, and save images
• Purchase credits used to generate AI images

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

4. Credits and Purchases

4.1 Credit System

AI image generation requires credits. Credits may be obtained by:

• Purchasing credit packs through the Apple App Store or Google Play Store
• Receiving weekly granted credits (subject to change)
• Signup bonuses (awarded upon email verification)
• Referral bonuses

4.2 Purchases

• All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms.
• Prices are displayed in your local currency as determined by the app store.
• Purchased credits do not expire. Granted (free) credits may expire or reset periodically.

4.3 Refunds

Refund requests must be directed to Apple or Google through their respective app store refund processes. We do not process refunds directly.

5. Your Content

5.1 Ownership

You retain ownership of the images you upload to Ma Styla. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, display, and distribute your content solely for the purpose of operating and providing the Service. This license ends when you delete your content or account (subject to reasonable backup and caching periods).

5.2 AI-Generated Content

Images generated by the AI service are created using your uploaded images and our AI technology. You may use AI-generated images for personal, non-commercial purposes. You acknowledge that:

• AI-generated results may vary in quality and accuracy.
• Generated images may not perfectly represent real clothing or appearances.
• We do not guarantee specific results from the AI generation process.
• Generation may fail and credits used for failed generations may or may not be refunded at our discretion.

5.3 Content Restrictions

You may not upload or generate content that:

• Is sexually explicit, pornographic, or depicts nudity
• Depicts violence, self-harm, or dangerous activities
• Is harassing, hateful, or discriminatory
• Infringes on the intellectual property rights of others
• Contains images of minors in inappropriate contexts
• Violates any applicable law or regulation
• Is spam or deceptive in nature

We use automated content moderation to detect prohibited content. Content that violates these restrictions may be removed, and your account may be suspended or terminated. You may request a human review of any automated moderation decision by contacting us at legal@mastyla.app.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload images of other people without their consent
• Attempt to reverse-engineer, decompile, or hack the Service
• Circumvent content moderation or safety systems
• Create multiple accounts to abuse free credits or referral bonuses
• Use automated tools, bots, or scrapers to access the Service
• Impersonate another person or entity
• Interfere with or disrupt the Service or its infrastructure

7. Account Privacy Settings

Your account is public by default, meaning your published images are visible to all users. You can set your account to private, which restricts your content to approved followers only. Regardless of your privacy setting, your username and profile image remain publicly visible.

8. Reporting and Moderation

You can report content or users that violate these Terms. We review reports and may take action including content removal, account suspension, or permanent termination. You may request a human review of any automated moderation decision by contacting us.

9. Account Suspension and Termination

• We may suspend or terminate your account if you violate these Terms.
• You may delete your account at any time through the app settings.
• Deleted accounts enter a 30-day grace period. During this time you can restore your account by logging back in. After 30 days, your data is permanently deleted.
• Accounts placed on legal hold may not be deleted until the hold is lifted.
• Accounts may be frozen for security reasons (e.g., suspected unauthorized access).

10. Intellectual Property

The Service, including its design, features, code, and branding, is owned by Ma Styla LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

11. Third-Party Services

The Service integrates with third-party services including Google Cloud AI, Apple App Store, Google Play Store, Firebase Analytics, and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

11.1 Analytics

With your consent, we may collect anonymous usage data through Firebase Analytics to understand how the Service is used and to improve the user experience. You can opt in during account registration and opt out at any time in Settings > Privacy & Connections. See our Privacy Policy for details on what data is collected and how it is used.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED IMAGES ARE PROVIDED WITHOUT ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR ACCURACY.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MA STYLA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING EU CONSUMER PROTECTION LAWS.

14. Indemnification

You agree to indemnify and hold harmless Ma Styla LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

15. Data Export

You may request an export of your personal data through the app. We will provide your data in a portable format within a reasonable time. See our Privacy Policy for full details of your data rights.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app and request your acceptance of the updated Terms before you continue using the Service. The version of the Terms you accepted is recorded in your account.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. If you are a consumer in the European Union, you also retain the protection of the mandatory provisions of consumer protection law in your country of residence. Any disputes shall be resolved in the courts located in Delaware, except where EU consumer law grants you the right to bring proceedings in your country of residence.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ma Styla LLC regarding your use of the Service.
